Terms of use

These terms govern access to wakaorbit.com and the use of the Waka Orbit services published by Wakacom S.L. They apply as soon as you access the site or use any of these services. If you do not agree with them, do not use the service.

Scope of the services

Waka Orbit provides conversational agents and customer-relationship automation tools: answering inbound requests, booking appointments, follow-ups, publishing content and tracking conversations, according to the scope subscribed. The public website presents these services; their implementation for a customer is covered by a separate agreement.

Commercial terms

This website is not a contractual offer. The agreed scope, prices, term, service levels and termination arrangements are those of the quotation or contract signed with Wakacom S.L. Where they differ, that document prevails over these terms.

Access and accounts

Some areas require an account. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for actions carried out with them. Tell us without delay if you suspect unauthorised access.

Acceptable use

You must not use the service to: break the law or infringe the rights of others; send unsolicited messages to people who have not consented; attempt to access data or systems without authorisation; disrupt, probe or circumvent the service; or introduce unlawful, misleading or degrading content. We may suspend access that endangers the security of the service or of its users.

AI-generated content

Answers and content produced by our agents are generated automatically. They may contain errors or inaccuracies and do not constitute legal, medical, financial or professional advice. It is your responsibility to verify information before relying on it for a decision. Where you publish such content under your own brand, you remain responsible for it.

Your content

You retain ownership of the content and data you entrust to us. You grant us the right to host and process it solely to the extent needed to deliver the service. You warrant that you hold the rights required for what you submit.

Intellectual property

The website, brand, interfaces and software components of Waka Orbit remain the property of Wakacom S.L. or its partners. Nothing in these terms transfers any of those rights.

Third-party services

The service relies on third-party platforms — including Microsoft Azure, Meta, Google and TikTok — whose use is subject to their own terms. Any interruption, limitation or change on their side may affect some or all features, through no fault of ours.

Availability

We take reasonable steps to keep the service running. It may nevertheless be interrupted for maintenance, updates or external causes. Any quantified availability commitment exists only if it appears in the signed contract.

Liability

The service is provided as is. To the extent permitted by law, Wakacom S.L. is not liable for indirect damages, in particular loss of revenue, loss of data or reputational harm arising from use of the service. None of these limitations applies in cases of gross negligence, wilful misconduct, or where the law does not allow them to be excluded.

Personal data

How personal data is processed is described in our privacy policy, and the use of trackers on the cookies page. Where we process data on behalf of a customer, we act as a processor within the meaning of the GDPR, on the terms set out in the contract.

Changes to these terms

These terms may change along with the service or the applicable regulations. The version that applies is the one published on this page at the time of your use. Any substantial change affecting an ongoing contract is notified to the customer concerned.

Governing law

These terms are governed by Spanish law. Failing an amicable settlement, any dispute falls within the exclusive jurisdiction of the courts of Pamplona, without prejudice to protective rules applicable to consumers.
